These terms govern the supply of the StreamingCams camera and its control panel (the “Product”) by Real View (“we”, “us”), the operator of StreamingCams, to the customer named on the order (“you”). By placing an order or using the Product you agree to these terms. Please read them carefully.
1. About us
StreamingCams is a product operated by Real View. You can contact us at support@real-view.tv.
2. The Product
The Product consists of:
- a plug-and-play weatherproof camera, supplied for you to install;
- access to an online control panel from which you connect a streaming channel (such as your own YouTube channel), aim the view, and start and stop the live stream; and
- the camera streaming your live view to the channel you connect.
The camera has no microphone and captures no audio. We may improve or change how the control panel works from time to time, provided the changes do not materially reduce what you have paid for.
3. Orders
A contract is formed when we confirm your order. The camera is sold as a one-off purchase; there is no subscription required to stream to your own channel. Any pre-order, waitlist or early-bird pricing is subject to availability and to the terms stated at the time.
4. Charges and payment
- The charge for the camera is as set out at checkout. Unless stated otherwise, prices are inclusive of VAT where applicable and exclusive of delivery, which is shown separately.
- Payment is taken at the time of order (or, for a pre-order, as stated when you place it).
- Streaming to your own YouTube (or other) channel is provided by that platform and is free of charge from us; any optional paid features we may offer will be described before you buy them.
5. Delivery, returns and cancellation
We will deliver to the address on your order and give an estimated dispatch time. If you are a consumer, you have the statutory right to cancel and return the camera within the applicable cooling-off period for a refund, provided it is returned in a resaleable condition; this does not affect your legal rights if the camera is faulty. Business purchases are subject to the returns terms stated on your order.
6. Installation and your location
The camera is supplied for you to install. So that it can run, you agree to:
- mount the camera in a safe, suitable position with a clear view;
- provide a network connection with internet that the camera can reach; the camera is powered over that connection (PoE), or via a PoE injector;
- obtain any permissions, consents or licences needed to install and operate a camera at the location; and
- position the camera so that it captures a view you are entitled to stream and does not point at areas where people have a reasonable expectation of privacy.
We can advise on positioning, but installation and its safety are your responsibility.
7. Equipment and software
The camera hardware is yours once paid for. The StreamingCams control panel, platform and software that operate the camera remain ours and are licensed to you for use with the camera under these terms.
8. Streaming and availability
We aim to keep the control panel and streaming running reliably but we do not guarantee uninterrupted or error-free streaming. The service depends on your location’s power and internet connection, and on third-party platforms (such as YouTube) whose availability, features and policies we do not control. We may occasionally suspend the service for maintenance and will try to give reasonable notice where practical.
9. Your stream and content
You are responsible for what you stream and for complying with the terms of any platform you connect (such as YouTube). You confirm you have the right to capture and publicly stream the view. By connecting a channel, you instruct us to publish your live view to it. If you switch on the optional Real View connection, you also instruct us to include your view in the Real View viewing service; you can switch this off at any time. You must not use the Product for anything unlawful or that infringes others’ rights.
10. Data protection and people in view
Our handling of personal data is described in our Privacy Policy. The camera captures video only (no audio) and is intended to show a view you choose to stream. Where a camera could capture identifiable individuals and you determine why and how that footage is used, you are the data controller for it; you are responsible for positioning the camera appropriately, for any signage required, for informing people where necessary, and for having a lawful basis for capturing and publishing the view. Each party agrees to comply with applicable data protection law.
11. Liability
Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited. Subject to that:
- we are not liable for loss of profit, loss of business, loss of goodwill, or any indirect or consequential loss;
- we are not liable for a stream that is interrupted or unavailable due to matters outside our reasonable control (including loss of power or internet at your location, or a third-party platform’s outage or policies); and
- our total liability in connection with the Product is limited to the price you paid for the camera.
Your statutory rights as a consumer are unaffected.
12. Events outside our control
We are not responsible for failure or delay caused by events outside our reasonable control, including power or network failures, extreme weather, acts of third parties, or interruption to hosting, connectivity or third-party platform services.
13. General
- We may transfer our rights and obligations to another organisation; your rights under these terms are not affected.
- If we do not insist on strict performance, that is not a waiver of our rights.
- If any part of these terms is found to be unenforceable, the rest continue to apply.
- These terms and your order form the entire agreement between us.
14. Governing law
These terms are governed by the law of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
